TERMS AND CONDITIONS OF HIRING

TERMS AND CONDITIONS OF HIRE – PLANT AND EQUIPMENT

1 DEFINITIONS AND INTERPRETATION
• (Definitions): Unless the context requires otherwise:
o Commencement Date means that date and time noted in the Schedule that the hire of the Plant and Equipment is to commence.
o Completion Date means that date and time noted in the Schedule or as extended in accordance with clause 2, that the hire of the Plant and Equipment is to cease.
o Confidential Information means the Schedule, the Hire Fee including any discount given, any payment information provided by the Hirer to Onestop Hire Gold Coast and the Plant and Equipment (to the extent information about the Plant and Equipment is not in the public domain).
o Damage Waiver Fee means the amount noted in the Rates Schedule or on the Schedule. Where noted in the Schedule, the Schedule will prevail over the Rates Schedule.
o Excess Amount means the amount payable in accordance with the Rates Schedule.
o GST refers to the goods and services tax under A New Tax System (Goods and Services) Act 1999 (“GST Act”) and the terms used have the meanings as defined in the GST Act.
o Hire Fee shall mean the price payable for the hire of Plant and Equipment as noted on the Schedule for the Hire Period.
o Hire Period means the that period of time between the Commencement Date and Completion Date (inclusive).
o Hire Rates means those fees and charges noted in the Rates Schedule.
o Hirer means the person or entity described in the Schedule.
o Onestop Hire Gold Coast means R & D mowers and equipment services pty ltd ACN 144637561.
o Insolvency Event means bankruptcy, administration, compromise, arrangement, amalgamation, reconstruction, winding up, dissolution and assignment for or compromise with creditors, not paying any debt as and when it falls due, and‘Insolvent’ will be construed accordingly.
o Plant and Equipment means that equipment as described in the Schedule with the relevant type, make and other identifiers.
o PPS Law has the meaning given in clause 15 of these Terms.
o Quote means an email, proposal or other document of Onestop Hire Gold Coast provided to the Hirer estimating a price for hiring Plant and Equipment requested by the Hirer.
o Rates Schedule means the schedule published by Onestop Hire Gold Coast entitled ‘Rates Schedule’ which details the current fees and charges application to and associated with the hire of Plant and Equipment from Onestop Hire Gold Coast.
o Responsibilities means those additional requirements noted in the Schedule that each party must undertake in respect of the Plant and Equipment, during or immediately before and after the Hire Period.
